Right of Withdrawal

The buyer shall in all cases have a period of fourteen (14) calendar days following receipt of the Product to exercise their right of withdrawal without having to justify reasons or incur any penalty. This shall not apply to services, which shall be governed by what is specified in the order sheets and the contracts.

The buyer must state their intention to withdraw within the indicated period and must proceed to return the product. To this end, the User may send an email to ciasat.aikotelematics.com including their name and address, as well as their order number. They may also contact us by telephone in order to expedite the refund process of the corresponding amounts.

MAM OBJECTS S.L. shall reimburse the amounts paid by the User without retaining any expenses. However, the cost of returning the product shall be borne by the User.

Once the products subject to the withdrawal have been received and their correct condition has been verified, MAM OBJECTS S.L. shall return to the User the amounts paid within a maximum period of 10 calendar days. Products that do not retain their original packaging may suffer depreciation.

The right of withdrawal shall be exercised in accordance with the provisions of Article 71 of Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws. The consumer and user shall be responsible for proving that they have exercised their right of withdrawal in accordance with Article 72 of the aforementioned law.

Returns and Withdrawal

Returns shall not be accepted in the following cases:

• When the supply of goods or services has been made in accordance with the specifications of the consumer and user or clearly personalised.
• When a commercial contract exists between the Client and MAM OBJECTS S.L., it shall be governed by the agreement between the parties and according to the literal terms of the contract. In the event of interpretation, Article 1281 et seq. of the Spanish Civil Code shall apply.
• The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
• The supply of services shall be subject to the actual functioning of things, and MAM OBJECTS S.L. shall not be liable for problems arising from the client's technological deficit that could reasonably have been foreseen.
• The burden of proof of the exercise of the right of withdrawal shall lie with the consumer and user.
• The exercise of the right of withdrawal shall extinguish the obligations of the parties to perform the distance contract or contract concluded away from the business premises.

3. INDUSTRIAL AND INTELLECTUAL PROPERTY

Competent forum: Any dispute shall be resolved before the Courts of First Instance and Instruction of Bilbao, unless any law or international treaty designates another competent forum.

Applicable law: Any dispute arising therefrom shall be governed by the following competent forums: Spanish laws, submission of the parties to the Spanish courts in accordance with Article 22 bis of the LOPJ, as well as to the enforcement of judgments; therefore, the Spanish courts shall have exclusive jurisdiction over any dispute.

In contracts concluded by electronic means, in which a consumer is a party, they shall be presumed to have been concluded in the place where the consumer has their habitual residence. Electronic contracts between businessmen or professionals, in the absence of an agreement between the parties, shall be presumed to have been concluded in the place where the service provider is established.

In the event that any stipulation of these General Conditions proves unenforceable or null by virtue of the applicable legislation or as a consequence of a judicial or administrative resolution, such unenforceability or nullity shall not render these General Conditions unenforceable or null as a whole. In such cases, the modification or replacement of said stipulation shall proceed with another that is valid and enforceable and that, insofar as possible, achieves the objective and intention reflected in the original stipulation.
